Joined Up Resources (CCW) End User Licence Agreement

Please take the time to read and understand this licence prior to installation.

IMPORTANT: YOU MUST NOT COPY OR SHARE CCW FONTS/SOFTWARE WITH ANYONE ELSE EXCEPT IN ACCORDANCE WITH THE END USER LICENCE AGREEMENT

By downloading and/or installing CCW fonts and/or software (Products) you agree to be bound by the terms of this Agreement. You should keep your receipt from the purchase of the software licence from CCW or its distributors as the receipt, in conjunction with this Agreement , constitutes the full agreement between you and CCW.

1. Permitted Uses

You are permitted to use the licensed Products to create images or logos and to embed the fonts under the terms described in Section 4 of this licence. You are not permitted to create letterform or alphabet products for resale using the licensed fonts if the product consists of individual letterforms (for example rubber stamps, die-cut products, stencils, stickers or other products where the likeness of the licensed fonts can be reproduced).

2. Grant of licence

The single-user CCW distributed software licence is limited for use on a maximum of 3 devices at one site. A device may be defined as a computer, printer, server or other machine which produces letterforms from font data. A site is defined as a single physical location. A laptop may be one of the devices defined within single-user licence of 3 devices provided that the laptop is based primarily at the licensed location. Working offsite on a laptop is permissible within the single-user licence and this is looked on as an extension of the “site”.

If you have purchased a school licence (your receipt will show this), you may install the Products on any number of devices within one location, or on a LAN/WAN Server with more than 3 devices.

3. Transfer and Third Party use

The licensed fonts may be provided to a service bureau or graphic designer which is working on your behalf only if they expressly agree to use the fonts exclusively for your work. They must agree and adhere to the terms of this licence and remove any copies of the fonts on completion of the work for you.

You must not share or distribute the licensed Products or make them accessible to any other third parties except when embedding in compliance with the rules described in Section Four below.

You may transfer the licence to another party only if you retain no copies of the Products after the transfer.

4. Embedding

a. Adobe Portable Document Format ("PDF") Embedding

You are permitted to embed the licensed fonts into any read-only PDF you send to third parties. Such documents must only be viewable and printable (not editable) by the recipients.

b. HTML Web Page Embedding

You are not permitted to embed the licensed fonts into HTML web pages except with the prior approval and written permission of CCW Resources. Additional licensing fees may apply.

c. Application and Game Embedding

You are not permitted to embed the licensed fonts into a computer application or game except with the prior approval and written permission of CCW Resources. Additional licensing fees may apply.

5. Modifications

You are permitted to use characters from the font as graphical objects in a drawing program and modify such graphical objects.

You must not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the licensed font itself without CCW Resources’ approval and prior written consent.

6. Copyright

The font, software and the accompanying materials are copyright materials and contain proprietary information belonging to CCW. Unauthorized copying of the software even if modified, merged, or included within other software, or of the written materials, is expressly forbidden. You may be held legally responsible for any infringement of the intellectual property rights due to your failure to abide by the terms of this Agreement.

7. Termination

This Agreement is effective until terminated. This Agreement will terminate automatically without notice from CCW if you fail to comply with any provision contained herein. Upon termination, you must destroy the written materials, the fonts and all copies of them, in part and in whole, including modified copies, if any.

8. Disclaimer and Limited Warranty

CCW warrants the Product to be free from defects in materials and workmanship under normal use for a period of twenty one (21) days from the date of delivery as shown on your receipt. CCW's entire liability and your exclusive remedy as to a defective product shall be, at CCW's option, either return of purchase price or replacement of any such product that is returned to CCW with a copy of the invoice. CCW shall have no responsibility to replace the product or refund the purchase price if failure results from accident, abuse or misapplication, or if any product is lost or damaged due to theft, fire, or negligence. Any replacement product will be warranted for twenty one (21) days. This warranty gives you specific legal rights. You may have other rights.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE PRODUCT, IS PROVIDED “AS IS”. CCW MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The entire risk as to the quality and performance of the Product rests upon you. CCW does not warrant that the functions contained in the Product will necessarily meet your requirements or that the operation of the software will be uninterrupted or error free.

CCW SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT EVEN IF CCW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Governing Law

This agreement is governed by the laws of the United Kingdom, even in the event that the exertion or breach of contractual rights takes place in a foreign country.
